Outcome

Vedanta's controversial bauxite mine on the Dongria Kondh’s tribal land has been stopped, after four years of protests by local peoples supported by Survival International and a wide range of affinity campaigns, including most recently by EI’s Earth Action Network.

Action Alert: UPDATE: India's Dongria Kondh Tribal Way of Life Threatened by British/International Vedanta Mining – Let’s Build on Initial Success

Vedanta Resources, a British/international mining company, is set to destroy the forests, wildlife and way of life of the Dongria Kondh people. The Dongria Kondh have been struggling with all their might to protect their mountain but are being overpowered by the financial and political might of this multi-billion dollar company. They have been protesting locally for years, and have appealed for international support for their campaign to keep their sacred Niyamgiri Mountain ecologically and culturally intact.

Alert Update - August 6, 2010

We have added a new protest email - the first one below - which is going to Indian government officials in support of local demands. Please take part in this new protest target. Also, our action to date has caused HSBC and WestLB banks to publicly distance themselves from Vedanta and Niyamgiri mining, an early success. This is reflected in the updated 2nd email to send. Please send both!

The Dongria Kondh are an indigenous tribe who have lived since time immemorial around the mountain Niyamgiri in the Indian state of Orissa. Because they revere this mountain as an important spiritual place, it has not thus far suffered the deforestation and degradation experienced by similar areas in that part of the world but contains an elephant reserve with Sambar, Leopard, Tiger, Barking Deer, various species of birds and other endangered species of wildlife.

However now Vedanta Resources, a truly international mining company registered in Britain to provide a thin veneer of credibility, is set to destroy the forests, wildlife and way of life of the Dongria Kondh people. The Dongria Kondh have been struggling with all their might to protect their mountain but are being overpowered by the  financial and political might of this multi-billion dollar company. In 2006, thousands of tribal people armed with bows and arrows came out to protest against the alumina refinery being set up by Britain's Vedanta Resources Plc. Local vociferous and effective protest continues to this day.

To support these local efforts, we believe that the key to stopping this from happening is for many people from around the world to write to the banks that finance Vedanta’s operations  and the UK’s Department of International Development who have key roles to play to prevent this disaster from taking place.

Many groups from around the world  have been campaigning to persuade  Vedanta's  shareholders and financiers to distance themselves from the company. As a result of their good work, the Church of England,   the Norwegian government's sovereign pension fund and several other of Vedanta's shareholders  have now sold their investments in the company, citing human rights concerns.

A group of international NGO's wrote to Vedanta's bankers in April this year asking them to dissociate themselves from the company. None of the banks have done so, so now it’s time to name and shame them, time for people from all around the world to send emails expressing our disgust that they continue  bankroll this disgraceful project.

Please click on "Take Action",  add your name, country and email and, with a few clicks of the mouse,  you can send emails to people who could, if they wished, prevent this ecological destruction and injustice from taking place. Please share this action alert with your friends and ask them to do the same.

** Your email will go to the following banks who have invested in Vedanta..

ANZ, Bank of Tokyo Mitsubishi UFJ, Barclays, BNP Paribas, China Construction Bank, China Ex-Im Bank, Citigroup, Crédit Agricole CIB, Deutsche Bank, Industrial and Commercial Bank of China, Intesa Sanpaolo, JPMorgan Chase, Macquarie bank, Merrill Lynch, Mizuho, Morgan Stanley, Natixis, Royal Bank of Scotland, Scotia Bank, Société Générale, Standard Chartered, State Bank of India, Sumitomo Mitsui Banking Corporation

World Demands You Stop Mining at Niyamgiri

Jairam Ramesh, Environment Minister of India

Dear Jairam Ramesh,

I am writing you to express my concern about the illegal
mining activities being conducted by Vedanta at Niyamgiri
in Orissa. The grave injustices occurring there, and the
threat to an intact ecosystem and proud ancient Indian
culture, have garnered international attention. We insist
that this project be canceled immediate.

In January this year, Prime Minister Manmohan Singh asked
all Indian states to ensure speedy implementation of the
forest land rights Act, so that benefits of the “landmark”
legislation reach tribals while preserving wildlife
habitats.

Vedanta Resources Ltd wants to mine the Niyamgiri Mountain
in Lanjigarh, Orissa. The mountain is a sacred part of the
traditional habitat of the Dongria Kondh community, an
impoverished adivasi community that worships the mountain
and depends on it for their water supply, for minor forest
produce and for the fertility of their lands. The Dongria
Kondhs also have rights to the mountain under sections
3(1)(c), 3(1)(e), 3(1)(i) and 3(1)(l) of the Forest Rights
Act. Under that law, their consent is also required before
the forest land can be used for any other purpose.

A report by an Environment Ministry committee is clear –
mining the mountain will violate the Forest Rights Act and
“threaten the existence as a tribe” of the Dongria Kondh.
The Orissa government is also clear; never mind the law, no
claim forms have been filled, so we can destroy the
mountain. It also says that no one lives on the mountain,
so no one’s rights will be affected.

• Did the government inform the adivasis of the Act? No.

• Did it distribute forms for community rights and follow
the procedures for inviting claims? No.

• Did it notice that no one lives on the mountain precisely
because the Dongria Kondhs protect the mountain for water,
food and as part of their faith? No.

• Did it implement the parts of the Act that deal not only
with where people live, but with their rights over the
forest they depend on? No.

When it is well known from history books and many reports
that the Dongria Kondhs have rights, it is the government’s
duty to ensure that those rights are recognised, not to
come up with excuses for ignoring them. Moreover, has the
Orissa government taken the consent of the people? No.

This is a test case. Reports now say that the Ministry of
Tribal Affairs has been asked whether the Forest Rights Act
has been implemented in the area. If Vedanta is given
clearance now, it will prove yet again that this government
cares nothing for the rule of law – and all the tall talk
about justice, human rights and democracy is just a fig
leaf for rapacious robbery.

We understand that you are under tremendous pressure to
cave in on this matter and give Vedanta the clearance they
hunger for. According to the “Economic Times” June 29 2010
the Prime Minister’s Office has written to you to give
clearance to the project and no doubt there is considerable
pressure from various interests who wish to drive tribals
out of their forest homes so that corporations can take
over their (natural) resources.

We applaud the integrity that you have shown thus far sir,
and beseech you to stand fast for the forests and
defenseless adivasis, the “first people” of your proud,
ancient land. Please be aware the world is watching.

With grave concern,
